Welcome to Breezio (the "Service"). These Terms of Service ("Terms") govern your access to and use of the Service, which is provided by Breezio ("we," "us," or "our") at breezio.cc. By accessing or using the Service, you agree to be bound by these Terms and our Privacy Policy. If you disagree with any part of the Terms, then you may not access the Service.
1. Acceptance of Terms
By accessing, browsing, or otherwise using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms and any additional policies or guidelines referenced herein. f. Breezio is an editorial guide to places, ideas, and experiences around Boston. The site is provided for personal, non-commercial inspiration. You agree to read information thoughtfully and make your own decisions about routes, weather, access, safety, and availability.
3. Editorial Information
We aim for useful, warm, and accurate writing, but conditions change. Opening hours, transit schedules, reservations, trail conditions, and seasonal access should be confirmed with the relevant venue or authority before a visit. Breezio does not promise that every detail will remain current. The Service may contain links to third-party websites or services that are not owned or controlled by us. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites or services.
4. Intellectual Property
The Service and its original content, features, and functionality — including but not limited to the Breezio name, original writing, visual design, layout, illustrations, and editorial archive — are and will remain the exclusive property of Breezio and its licensors. Our trademarks and trade dress may not be used in connection with any product or service without our prior written consent. You may read and share links for personal use, but you may not copy, republish, sell, or systematically collect our content without written permission.
5. User Content
If you post, link, or otherwise make available content through the Service ("User Content") — including notes, suggestions, or photographs submitted via the contact form — you grant us a non-exclusive, worldwide, royalty-free license to use, modify, publicly perform, publicly display, reproduce, and distribute such User Content on and through the Service. You retain any and all of your rights to any User Content you submit. You are responsible for your User Content, including its legality, reliability, and appropriateness, and you confirm that you have the right to share it. Please do not send confidential information.
6. Account Cancellation and Suspension
We may terminate or suspend your access to our Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms. You may also request to deactivate or delete your account or any submitted information at any time by contacting us at the address listed below. Your use of the Service is at your sole risk. The Service is provided on an "AS IS" and "AS AVAILABLE" basis. The Service is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance. We do not warrant that the Service will be uninterrupted, error-free, secure, or that any information on the Service is accurate, complete, or current at all times.
8. Limitation of Liability
In no event shall Breezio, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages — including without limitation loss of profits, data, use, goodwill, or other intangible losses — resulting from (a) your access to or use of or inability to access or use the Service; (b) any conduct or content of any third party on the Service; or (c) unauthorized access, use, or alteration of your transmissions or content. Your use of recommendations is voluntary. Breezio is not responsible for loss, injury, travel disruption, or changes at any place mentioned on the Service.
9. Indemnification
You agree to defend, indemnify, and hold us harmless from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees) resulting from or arising out of your use and access of the Service, your breach of these Terms, or your violation of any rights of another party.
10. Changes to Terms
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will try to provide at least 30 days' notice prior to any new terms taking effect. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised Terms. The date at the top of this page will indicate when the latest version was published.
11. Dispute Resolution
Any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall first be attempted to be resolved through good-faith negotiation. If the dispute cannot be resolved through negotiation within thirty (30) days, the dispute shall be submitted to binding arbitration administered under the commercial arbitration rules then in effect. The arbitration shall take place in Boston, Massachusetts, and judgment on the award rendered by the arbitrator may be entered in any court having jurisdiction. This dispute resolution clause shall not apply to claims for injunctive or equitable relief regarding intellectual property rights.
12. Governing Law and Jurisdiction
These Terms and any dispute arising under them shall be governed by and construed in accordance with the laws of the United States of America and the Commonwealth of Massachusetts, without regard to its conflict of law provisions. You agree that the courts located in Suffolk County, Massachusetts, USA shall have exclusive jurisdiction over any claim or dispute arising out of or relating to these Terms or the Service. You hereby consent to the personal jurisdiction of such courts and waive any objection based on improper venue or forum non conveniens.
13. Entire Agreement
These Terms constitute the entire agreement between us regarding our Service and supersede and replace any prior agreements or understandings we might have had between us regarding the Service. If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
